{"id":86796,"date":"2026-07-30T09:05:25","date_gmt":"2026-07-30T09:05:25","guid":{"rendered":"https:\/\/www.cryptocabaret.com\/?p=86796"},"modified":"2026-07-30T09:05:25","modified_gmt":"2026-07-30T09:05:25","slug":"vietnam-uses-hianime-arrests-as-defense-against-u-s-trade-sanctions","status":"publish","type":"post","link":"https:\/\/www.cryptocabaret.com\/?p=86796","title":{"rendered":"Vietnam Uses HiAnime Arrests As Defense Against U.S. Trade Sanctions"},"content":{"rendered":"<p><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/vietnam-wall-flag-1.jpg\" alt=\"vietnam wall flag\" width=\"300\" height=\"205\" class=\"alignright size-full wp-image-245475\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/vietnam-wall-flag-1.jpg 1219w, https:\/\/torrentfreak.com\/images\/vietnam-wall-flag-300x205.jpg 300w\" sizes=\"(max-width: 300px) 100vw, 300px\">Earlier this year, the U.S. Trade Representative (USTR) classified Vietnam as \u201c<a href=\"https:\/\/torrentfreak.com\/u-s-brands-vietnam-as-a-rare-priority-foreign-country-over-online-piracy-concerns\/\">Priority Foreign Country<\/a>,\u201d because of its lacking anti-piracy enforcement.<\/p>\n<p>That designation, applied for the first time in over a decade, triggered a <a href=\"https:\/\/torrentfreak.com\/vietnams-online-piracy-failures-trigger-section-301-investigation-tariffs-on-the-table\/\">Section 301 investigation<\/a>, opening the door to potential trade sanctions.<\/p>\n<p>As part of this process, stakeholders were requested to provide input on Vietnam\u2019s alleged shortcomings. This includes the piracy challenges and concerns, which were highlighted as the primary concern.<\/p>\n<p>One of the key submissions came from the Motion Picture Association (MPA). As we <a href=\"https:\/\/torrentfreak.com\/hollywood-wants-vietnam-to-slay-the-piracy-hydra\/\">reported earlier<\/a>, Hollywood\u2019s trade group called for tougher prison sentences and action against copycat pirate sites that swiftly take the place of ones that are shut down. <\/p>\n<p>In total, there were more than 170 submissions from stakeholders. These include a massive 3,500+ page response filed on behalf of the Government of Vietnam, which we initially missed. It is worth highlighting separately, however, as the timing ties into the broader enforcement picture.<\/p>\n<h2>Vietnam Responds<\/h2>\n<p>Vietnam filed its response on July 2, before the USTR deadline. As expected, the country argues that it doesn\u2019t belong on the priority watchlist, because its practices are not \u201cunreasonable or discriminatory,\u201d and they do not \u201cburden or restrict U.S. commerce,\u201d the two tests that matter under Section 301.<\/p>\n<p>Instead, the country argues that any remaining problems are mostly capacity limitations, not policy shortcomings.<\/p>\n<\/p>\n<p><center><em>\u2018Capacity constraints\u2019<\/em><\/center><center><br \/><\/center><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/capacity.png\" alt=\"capacity\" width=\"600\" height=\"189\" class=\"alignnone size-full wp-image-279842\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/capacity.png 1534w, https:\/\/torrentfreak.com\/images\/capacity-300x94.png 300w, https:\/\/torrentfreak.com\/images\/capacity-600x189.png 600w, https:\/\/torrentfreak.com\/images\/capacity-150x47.png 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>The submission closes by asking USTR to reconsider its stance, and remove Vietnam from the Priority Foreign Country List, without issuing any sanctions or imposing trade tariffs.<\/p>\n<h2>Piracy Crackdowns and Site Blocking as Defense<\/h2>\n<p>To back up its request, Vietnam cites a variety of anti-piracy efforts. The submission notes that more than 1,200 pirated websites were blocked in 2025, which is notable as the U.S. itself is <a href=\"https:\/\/torrentfreak.com\/google-opposes-site-blocking-in-europe-as-u-s-piracy-blocking-plans-gain-momentum\/\">still mulling<\/a> its own site blocking legislation. <\/p>\n<p>The report also cites other prominent enforcement actions. This includes the shutdown and prosecution of the <a href=\"https:\/\/torrentfreak.com\/fmovies-piracy-ring-was-shut-down-by-vietnam-assisted-by-ace-240829\/\">Fmovies piracy ring<\/a>, which was once the largest online piracy operation. This operation was dismantled in 2024 with intelligence from ACE, the MPA\u2019s anti-piracy arm.<\/p>\n<p>Meanwhile, Vietnam also mentions the shutdowns of Xoilac TV, Rophim, and Y2Mate. The latter operation was taken down in collaboration with <a href=\"https:\/\/torrentfreak.com\/y2mate-com-among-a-dozen-youtube-rippers-shut-down-by-ifpi-251015\/\">music group IFPI<\/a>, which should signal to Washington that it is cooperating on intellectual property matters. <\/p>\n<h2>The HiAnime Card<\/h2>\n<p>What stands out most in the submission is the timely mention of the HiAnime prosecution. This was publicly announced by the Vietnamese authorities on July 2, the same day that it submitted its USTR rebuttal. <\/p>\n<p>The submission tells USTR that \u201con 1 July 2026, the Ministry of Public Security initiated criminal proceedings [\u2026] against 07 suspects\u201d under Article 225 of the Criminal Code. It references more than 100 websites offering over 26,000 unauthorized films and roughly USD 12.85 million in advertising revenue.<\/p>\n<\/p>\n<p><center><em>Prosecution<\/em><\/center><center><br \/><\/center><center><\/center><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/proceedings.png\" alt=\"proceedings\" width=\"600\" height=\"189\" class=\"alignnone size-full wp-image-279849\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2026\/07\/proceedings.png 1540w, https:\/\/torrentfreak.com\/images\/proceedings-300x94.png 300w, https:\/\/torrentfreak.com\/images\/proceedings-600x189.png 600w, https:\/\/torrentfreak.com\/images\/proceedings-150x47.png 150w, https:\/\/torrentfreak.com\/images\/proceedings-1536x483.png 1536w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>While HiAnime isn\u2019t mentioned in this description, we were able to pinpoint it as the <a href=\"https:\/\/torrentfreak.com\/alleged-operators-of-hianime-piracy-ring-arrested-in-vietnam-with-u-s-support\/\">key target in this prosecution<\/a>, which was also <a href=\"https:\/\/www.linkedin.com\/posts\/alliance-for-creativity-and-entertainment_nh%C3%B3m-l%E1%BA%ADp-h%C6%A1n-100-website-%C4%91%E1%BB%83-%C4%91%C4%83ng-t%E1%BA%A3i-26000-activity-7478450753477517313-EI8I?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAABZbwIBje2xsTkq3JBcmlrBHk9VnQRQ5p8\">confirmed by ACE<\/a>. <\/p>\n<p>Vietnam\u2019s USTR submission does mention HiAnime.to by name elsewhere, among the sites and services that were \u201cshut down or forced to terminate their operations.\u201d <\/p>\n<p>Crucially, the HiAnime operation already closed its doors in March, months before the prosecution was announced on July 2. This coincides with the USTR submission deadline, where that same prosecution is used in Vietnam\u2019s defense. <\/p>\n<p>Whether the timing is coincidence or tied to the deadline is unknown.<\/p>\n<h2>All Eyes on the Sentences<\/h2>\n<p>The enforcement actions highlighted by Vietnam are not news. The MPA and USTR have acknowledged the same takedowns, but complained that the resulting sentences carry no deterrent. For example, the Fmovies operators previously <a href=\"https:\/\/torrentfreak.com\/fmovies-operators-of-worlds-largest-piracy-ring-dodge-prison-250508\/\">dodged prison<\/a>, which allegedly does little to tackle the country\u2019s piracy image. <\/p>\n<p>Vietnam does not dispute this. Its submission restates the U.S. view that enforcement has been \u201clight, mainly suspended sentences and low fines,\u201d and answers by asking Washington to \u201crecognize the efforts undertaken\u201d rather than defending the outcomes.<\/p>\n<p>What it offers instead is to update the current legislation. The MPA previously noted that Vietnam\u2019s Ministry of Public Security is drafting amendments to the Penal Code to better address high-tech crimes and cyber offenses.<\/p>\n<p>Whether that will indeed result in harsher sentences and a deterrent effect that will make it less appealing for locals to run pirate sites has yet to be seen. <\/p>\n<p>The HiAnime defendants are the next test. Four remain in custody awaiting trial, while the other three were placed under travel restrictions.
