The Japanese gaming company has won several lawsuits and previously referred the infamous hacking group Team-Xecuter to U.S. authorities, which <a href=\"https:\/\/torrentfreak.com\/us-indicts-several-members-of-piracy-group-team-xecuter-two-arrested-201002\/\">led to its demise<\/a>. <\/p>\n<h2>Initial Denial<\/h2>\n<p>In the complaint, Nintendo alleged that Modded Hardware sold devices designed to circumvent its piracy protections. These include mod chips and \u2018MIG Switch\u2019 devices, which allow people to play pirated copies of Nintendo Switch games on authentic consoles.<\/p>\n<p>In October 2024, Daly responded to the lawsuit pro se (without an attorney), <a href=\"https:\/\/torrentfreak.com\/modded-hardware-defendant-denies-nintendos-copyright-claims-in-court-241006\/\">denying any wrongdoing<\/a>. He specifically denied the claim that he owned and operated the Modded Hardware business. After the parties agreed on a joint stipulation late last week, that scenario will likely be avoided.<\/p>\n<h2>Modded Hardware &amp; Nintendo Reach Settlement<\/h2>\n<p>Following private discussions, both parties agreed to a final judgment in which Daly agrees that he trafficked in \u201ccircumvention devices\u201d and \u201chacked consoles\u201d that allowed Nintendo Switch users to play pirated games. According to the proposed judgment, this violated Nintendo\u2019s rights under the DMCA and the U.S. Copyright Act.<\/p>\n<p>As part of this settlement, Nintendo will be awarded $2,000,000 in compensation. There is no specific breakdown for this damages figure, but the stipulation mentions that Nintendo suffered losses due to the piracy enabled through Modded Hardware.<\/p>\n<\/p>\n<p><center><em>$2 million<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2025\/09\/2mnint.jpg\" alt=\"2 million\" width=\"600\" height=\"139\" class=\"alignnone size-full wp-image-271843\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2025\/09\/2mnint.jpg 1055w, https:\/\/torrentfreak.com\/images\/2mnint-300x70.jpg 300w, https:\/\/torrentfreak.com\/images\/2mnint-600x139.jpg 600w, https:\/\/torrentfreak.com\/images\/2mnint-150x35.jpg 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>\u201cDefendant\u2019s conduct has caused NOA significant and irreparable harm. For example, the MIG Devices, Mod Chips, Hacked Consoles, and Circumvention Services allow members of the public to create, distribute, and play pirated Nintendo games on a massive scale,\u201d the proposed judgment reads. <\/p>\n<h2>Permanent Injunction<\/h2>\n<p>In addition to the agreed judgment, Nintendo and Daly also reached agreement on a permanent injunction. This prohibits the defendant from owning, selling, creating, or trafficking in \u201cCircumvention Devices\u201d such as mod chips, MIG Dumpers, MIG Switches, and \u201cHacked Consoles\u201d.<\/p>\n<p>Even linking to third-party sites that offer these devices is off-limits. In addition, Daly is personally restrained from reverse engineering or otherwise tampering with any of Nintendo\u2019s products going forward. <\/p>\n<p>Finally, the proposed injunction requires the defendant to hand over the moddedhearware.com domain name to Nintendo, while destroying any circumvention devices still in his possession.<\/p>\n<p>The provided documents don\u2019t include any background on how this settlement was reached, but it is clear that both parties prefer not to go to trial.
