LaLiga paints Cloudflare as an uncooperative villain<\/a> who must now take responsibility for the consequences of its own inaction. And LaLiga has every right to take that position, just as Cloudflare has the right to refute the allegations. <\/p>\n In many parts of Spain, meanwhile, fundamental EU rights may face challenges: Article 11: Freedom of expression and information, and Article 16: Freedom to conduct a business, for example. LALIGA, backed by the justice system, will not relent in its efforts to protect football and the interests of its clubs against criminal action related to audiovisual fraud and digital laundering.<\/em><\/p>\n<\/blockquote>\n A new statement from LaLiga celebrates the successful blocking of two additional pirate IPTV services, DazcFutbolios and RBTV77, both of which reportedly used Cloudflare as a \u201cdigital shield\u201d to stay online.<\/p>\n \u201cIn its ongoing commitment to protecting intellectual property rights, LALIGA has successfully blocked illegal broadcasts from the DazcFutbolios and RBTV77 platforms this weekend,\u201d LaLiga\u2019s statement reads.<\/p>\n \u201cThese illegal platforms, which allowed the unauthorized transmission of football matches, operated both on the Web and in Apps, and used Cloudflare\u2019s infrastructure and resources to hide their criminal activity alongside legitimate domains, which are used as a digital shield, in order to try to evade security controls. Between them, they account for more than 400,000 unique monthly users in Spain.\u201d <\/p>\n From a business perspective, LaLiga\u2019s recent statements address most of the key talking points underpinning the current controversy. The league says it obtained authority from a court but also understood that cooperation from Cloudflare would make a difficult job a lot easier. <\/p>\n \u201cThese blocks, which are neither massive nor indiscriminate as LALIGA has previously stated, have also disabled a series of IPs specifically identified as hosting pirate services and unauthorized streaming services that operated in parallel,\u201d the statements adds.<\/p>\n In disputes of this magnitude, the devil can often be found in the detail. Before LaLiga obtained the court order, it knew that Cloudflare is generally opposed to blocking; hardly a revelation for a company with a mission to improve online connectivity. In the knowledge that collateral damage was inevitable, LaLiga had a choice too. Having made that choice, Cloudflare is framed as the party responsible for the collateral damage, despite the power to avoid that ultimately belonging to LaLiga.<\/p>\n Describing the blocks as neither massive nor indiscriminate is completely accurate, at least without context. The image to the right shows that LaLiga carefully selected its targets by blocking not one but several IP addresses, each with an unknown number of innocent sites behind them, in addition to the intended targets. <\/p>\n LaLiga wasn\u2019t indiscriminate when it selected the IP addresses, nor did it block a massive number of them. That simply isn\u2019t required; Cloudflare services a huge number of important websites in Spain<\/a> using relatively few IP addresses.<\/p>\n Given that this dispute looks set to continue and backing down has been ruled out, the question of intervention raises its head and who might be responsible for preventing a potential national disaster. If malicious hackers had caused a similar loss in connectivity, Spain\u2019s Ministry of Communications would be a logical choice. Thus far, we\u2019re unaware of any action, or indeed any interest from groups that may have any power to step in.<\/p>\n Historically, ISPs have ensured that blocking orders \u201cdo no harm\u201d in their quest to block pirate sites. The mechanism in Spain is unclear but at least thus far, the ISPs involved are informing the public they\u2019re not to blame and are simply obeying orders<\/a>. <\/p>\n Of course, attending court to negotiate the terms of blocking is always part of the process, just as it is for Cloudflare now, LaLiga insists. The truth is, choices are available in every direction but the only ones suitable for consideration put Spain\u2019s internet users first.<\/p>\n<\/p>\n Update<\/strong>: Statement by LaLiga<\/p>\n In response to the statement publicly released by Cloudflare this Wednesday, LALIGA wants to clarify that the fact that Cloudflare claims it is regularly collaborating with rights holders to resolve illegal broadcasts is absolutely false. In other countries such as France, Germany, Italy, and Portugal, rights holders have also taken legal action against Cloudflare in court due to its lack of cooperation in eradicating audiovisual fraud. Specifically, in Italy, they have even failed to comply with these condemnatory judicial rulings.<\/em><\/p>\n LALIGA, as it has always done with other internet operators, has made numerous requests to Cloudflare seeking its cooperation, to which they have responded with implausible and incoherent technological excuses, reaffirming their conduct. This is yet another demonstration that, while Cloudflare proclaims itself a defender of an open Internet, the reality is that it only seeks to continue profiting, using other clients as a digital shield while consciously protecting criminal organizations. LALIGA also positions itself as a defender of an open Internet, but never of an Internet where crimes against intellectual property can be committed with impunity. In the case of Cloudflare, it collaborates so that this impunity exists through its technology, facilitating the commission of the most serious crimes such as child pornography, prostitution, fraud, etc.<\/p>\n Furthermore, LALIGA once again denies that there are massive and indiscriminate content blocks, nor that they are clumsy or ineffective, but rather the result of an effective action carried out by a specialized team, following exhaustive precautions at all levels. In its continuous commitment to protecting intellectual property rights, and with the pertinent judicial protection, LALIGA has absolute certainty and accredited proof that the IPs requested for blocking are being used to distribute illegal content and are shared with legitimate content, with Cloudflare being solely responsible for this.<\/p>\n Due to Cloudflare\u2019s inaction and lack of protection towards its own users, LALIGA has made itself available to Cloudflare and has also opened a mailbox for clients who may have been affected by these blocks.
