While it would have been easy to let these \u2018anonymous\u2019 cheaters slide, Bungie vowed to leave no stone unturned, stating that the days of cheating \u201cwithout fear of consequences are over.\u201d<\/p>\n<\/p>\n<p><center><em>Bungie\u2019s Warning<\/em><\/center><br \/><center><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/bungie-warning.png\" alt=\"bungie-warning\" width=\"600\" height=\"104\" class=\"alignnone size-full wp-image-252583\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/bungie-warning.png 969w, https:\/\/torrentfreak.com\/images\/bungie-warning-300x52.png 300w\" sizes=\"(max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<h2>Relentless Pursuit to Unmask Cheaters<\/h2>\n<p>Bungie\u2019s strongly worded warning <a href=\"https:\/\/torrentfreak.com\/bungies-vow-to-relentlessly-pursue-anonymous-cheaters-was-no-bluff-240605\/\">was no bluff<\/a>. During the past year, the game company used third-party discovery to gather more information on both the named defendants and the anonymous Does. Over a dozen names and nicknames were added to the lawsuit, and more could follow. <\/p>\n<p>In August, Bungie filed a sealed motion for expedited discovery, requesting permission to subpoena additional third parties for information.  The request was granted a month later, but the names of the target companies were redacted.<\/p>\n<\/p>\n<p><center><em>Discovery Granted<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/bung-granted.jpg\" alt=\"granted\" width=\"600\" height=\"195\" class=\"alignnone size-full wp-image-261231\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/bung-granted.jpg 1039w, https:\/\/torrentfreak.com\/images\/bung-granted-300x98.jpg 300w, https:\/\/torrentfreak.com\/images\/bung-granted-600x195.jpg 600w, https:\/\/torrentfreak.com\/images\/bung-granted-150x49.jpg 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>The United States-based cryptocurrency exchange Kraken was later confirmed as one of the targets. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Kraken_(company)\">Kraken<\/a> is a brand of Payward Inc. and a few weeks ago Bungie sent a subpoena to the company, requesting detailed information on the owner of a Bitcoin wallet. <\/p>\n<h2>Bungie Goes After Kraken Bitcoin Wallet<\/h2>\n<p>The subpoena doesn\u2019t explain the relevance of the requested information, at least not publicly, but Bungie is asking for details related to the multi-signature wallet <em>36io3TPCi2i6muiBoiNkkJLCnw38PgrQWs<\/em>. <\/p>\n<p>According to blockchain data, this wallet was used to send and receive more than ten bitcoins <a href=\"https:\/\/www.blockchain.com\/explorer\/addresses\/btc\/36io3TPCi2i6muiBoiNkkJLCnw38PgrQWs\">between March 2021 and November 2024<\/a>. At the time of writing, however, the wallet is completely empty.<\/p>\n<p>Bungie is interested in any and all information relating to the wallet and its owner. This includes personal details, transaction records, access records, withdrawals, deposits, communication, IP-addresses, and more. <\/p>\n<\/p>\n<p><center><em>Some of the Requested Info<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/tobeproduced.jpg\" alt=\"to be produced\" width=\"600\" height=\"211\" class=\"alignnone size-full wp-image-261230\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/tobeproduced.jpg 1036w, https:\/\/torrentfreak.com\/images\/tobeproduced-300x106.jpg 300w, https:\/\/torrentfreak.com\/images\/tobeproduced-600x211.jpg 600w, https:\/\/torrentfreak.com\/images\/tobeproduced-150x53.jpg 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<h2>Wallet Owner Objects<\/h2>\n<p>The owner of the wallet remains unidentified for now, but the John Doe is not pleased with Bungie\u2019s evidence gathering tactic. This week, they submitted a motion to quash the subpoena, arguing that it fails to comply with federal rules and international privacy regulations. <\/p>\n<p>The \u201cJohn Doe\u201d explains, for example, that the subpoena doesn\u2019t provide any evidence explaining why the wallet information is relevant for the underlying lawsuit. In addition, it allegedly goes beyond geographical limits, as the wallet owner is a European resident.  <\/p>\n<p>The European angle is also important from a privacy standpoint. The wallet owner reportedly used a European affiliate of Payward, which is bound to European privacy regulations including the GDPR. This means that personal information can\u2019t be shared with the U.S. without proper safeguards.<\/p>\n<p>\u201cApparently, a Payward affiliate located in the European Union that provided services to Objector transferred Objector\u2019s information to Payward in the U.S. It is unclear how the EU affiliate justified such data transfer to the U.S.,\u201d the motion to quash adds.<\/p>\n<p>\u201cWithout binding measures ensuring compliance with GDPR standards, any transfer of Objector\u2019s personal data would be unlawful under the EU\u2019s GDPR.\u201d <\/p>\n<p>To strengthen this privacy argument, the filing references several cases where U.S. companies were fined in the EU for privacy violations. Uber, for example, received a <a href=\"https:\/\/www.edpb.europa.eu\/news\/news\/2024\/dutch-sa-imposes-fine-290-million-euro-uber-because-transfers-drivers-data-us_en\">290 million euro fine<\/a> because it transferred drivers\u2019 data to the U.S.<\/p>\n<p>Responding to the motion, Bungie argued on Thursday that the \u201cJohn Doe\u201d should reveal their identity. The company argues that parties must presumptively litigate under their real names, and pseudonymous litigation is reserved for \u201cunusual cases.\u201d<\/p>\n<p>The court has yet to rule on the motion to quash, but it\u2019s clear that Bungie\u2019s efforts to unmask alleged cheaters aren\u2019t always straightforward.
