These removals also triggered a legal battle between stream-ripper <a href=\"https:\/\/torrentfreak.com\/appeals-court-hears-riaa-and-yout-in-high-stakes-streamripper-case-240209\/\">Yout.com and the RIAA<\/a>, which remains ongoing today.<\/p>\n<p>YouTube hasn\u2019t taken an official stance on the \u2018circumvention\u2019 argument but since its sister company Google honors these takedowns, it seems to agree with the music industry. However, not all MP3-related sites are inherently problematic. <\/p>\n<h2>MP3.to<\/h2>\n<p>A few weeks ago, Spanish music industry group <a href=\"https:\/\/www.promusicae.es\/en\/\">Promusicae<\/a> flagged hundreds of <a href=\"https:\/\/lumendatabase.org\/notices\/44375864?access_token=2lGm88CTcwmFVUZrKFafrg\">stream-ripper URLs<\/a> in yet another anti-circumvention takedown notice. Grouped in with popular stream-rippers such as flvto, Y2mate, and 2conv was a clear outlier: <a href=\"https:\/\/www.mp3.to\/\">MP3.to<\/a>.<\/p>\n<\/p>\n<p><center><em>Promusicae Takedown<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/mp3to-dmca.jpg\" alt=\"mp3to dmca\" width=\"400\" height=\"110\" class=\"alignnone size-full wp-image-261148\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/mp3to-dmca.jpg 724w, https:\/\/torrentfreak.com\/images\/mp3to-dmca-300x82.jpg 300w, https:\/\/torrentfreak.com\/images\/mp3to-dmca-600x165.jpg 600w, https:\/\/torrentfreak.com\/images\/mp3to-dmca-150x41.jpg 150w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\"><\/center><\/p>\n<p>It\u2019s important to note that MP3.to is not a stream-ripping tool. It cannot download content from third-party sites. Instead, this online tool focuses solely on converting audio files between MP3 and other formats.<\/p>\n<\/p>\n<p><center><em>MP3.to<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/mp3to.jpg\" alt=\"\" width=\"500\" height=\"331\" class=\"alignnone size-full wp-image-261146\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/mp3to.jpg 1087w, https:\/\/torrentfreak.com\/images\/mp3to-300x199.jpg 300w, https:\/\/torrentfreak.com\/images\/mp3to-600x397.jpg 600w, https:\/\/torrentfreak.com\/images\/mp3to-150x99.jpg 150w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\"><\/center><\/p>\n<p>File-conversion tools that convert MP3s, without built-in access controls such as DRM, are unlikely to violate the DMCA\u2019s anti-circumvention provision. However, that didn\u2019t stop Google from honoring the request and removing the URL from its search engine. <\/p>\n<h2>MP3.to Fights Back<\/h2>\n<p>The removal, which also affected the associated AdSense advertising account, came as a surprise to MP3.to and directly harmed its business.<\/p>\n<p>To remedy the situation, MP3.to\u2019s law firm Boston Law Group sent a cease and desist letter to Promusicae, describing the takedown notice as defamatory and false. The attorney urged the music group to correct the error by issuing a retraction within ten days. <\/p>\n<p>\u201cThe Notice\u2019s allegations that the Website provides technology or tools used to circumvent a technological measure that effectively controls access to copyright works is categorically false and the Website unconditionally denies your allegations of wrongdoing.  <\/p>\n<p>\u201cThe Website does not decrypt any technological controls implemented to protect copyrighted works,\u201d MP3.to\u2019s cease-and-desist letter added. <\/p>\n<\/p>\n<p><center><em>MP3.to Cease and Desist, sent to Promusicae<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/promus-letter.jpg\" alt=\"promusicae\" width=\"600\" height=\"383\" class=\"alignnone size-full wp-image-261154\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/promus-letter.jpg 974w, https:\/\/torrentfreak.com\/images\/promus-letter-300x192.jpg 300w, https:\/\/torrentfreak.com\/images\/promus-letter-600x383.jpg 600w, https:\/\/torrentfreak.com\/images\/promus-letter-150x96.jpg 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>In addition, MP3.to\u2019s attorney Frank Scardino also sent a notice to Google explaining the situation. This letter explained that MP3.to adheres to relevant copyright law and doesn\u2019t circumvent any protection measures. <\/p>\n<p>Because there are no copyright infringements, MP3.to urged Google to undo all actions it took in response to the \u2018false\u2019 takedown notice. <\/p>\n<p>\u201cTherefore, the Website requests that Google disregard Promusicae\u2019s Notice, restore Google\u2019s Adsense account with respect to the Website, rescind any additional negative actions Google may have taken against the Website on account of the Notice,\u201d the letter reads. <\/p>\n<\/p>\n<p><center><em>MP3.to\u2019s letter to Google<\/em><\/center><br \/><center><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/google-letter.jpg\" alt=\"google\" width=\"600\" height=\"359\" class=\"alignnone size-full wp-image-261155\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2024\/12\/google-letter.jpg 971w, https:\/\/torrentfreak.com\/images\/google-letter-300x180.jpg 300w, https:\/\/torrentfreak.com\/images\/google-letter-600x359.jpg 600w, https:\/\/torrentfreak.com\/images\/google-letter-150x90.jpg 150w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<h2>Google Restores MP3.to<\/h2>\n<p>After receiving these letters two weeks ago and conducting an internal review, Google eventually reinstated the MP3.to URL. The associated AdSense account is no longer affected either. <\/p>\n<p>A Google spokesperson informed us that all websites impacted by takedowns are allowed to request a re-review, after which errors can be corrected. <\/p>\n<p>\u201cOur DMCA removals process aims to strike a balance between making it easy and efficient for rightsholders to report infringing content while also protecting free expression on the web. We provide extensive transparency and submit notices to Lumen to ensure accountability,\u201d the spokesperson said.  <\/p>\n<p><em>Note: Google previously said that there is <a href=\"https:\/\/torrentfreak.com\/scammers-hit-pirate-game-sites-with-irreversible-google-takedowns-181130\/\">no formal counter notification process<\/a> available under US law for circumvention. <\/em><\/p>\n<p>Promusicae has not yet responded to a request for comment. It\u2019s possible that this takedown request was an inadvertent error on their end, confusing MP3.to with a stream-ripper. <\/p>\n<h2>Familiar Target &amp; More Backlash<\/h2>\n<p><a href=\"https:\/\/www.mp3.to\/about\/\">MP3.to operator<\/a> Johnathan Nader is pleased with the outcome. Regular readers may recognize the name, as Nader is also the owner of stream-ripper Yout.com, and is actively engaged in the aforementioned legal battle with the RIAA. <\/p>\n<p>Nader, who has grown skeptical of music industry groups, finds it \u201cinteresting\u201d that he is being targeted yet again. In this case, however, things were resolved in his favor. <\/p>\n<p>This brings us to the final issue with Promusicae\u2019s takedown request. As it turns out, MP3.to was not the only file conversion site targeted.
