{"id":73459,"date":"2023-05-30T09:01:00","date_gmt":"2023-05-30T09:01:00","guid":{"rendered":"https:\/\/www.cryptocabaret.com\/?p=73459"},"modified":"2023-05-30T09:01:00","modified_gmt":"2023-05-30T09:01:00","slug":"yout-counters-riaa-in-court-quoting-lyrics-highlighting-youtubes-absence","status":"publish","type":"post","link":"https:\/\/www.cryptocabaret.com\/?p=73459","title":{"rendered":"Yout Counters RIAA in Court, Quoting Lyrics &amp; Highlighting YouTube\u2019s Absence"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2023\/05\/yout-logo-2.jpg\" alt=\"yout logo\" width=\"300\" height=\"172\" class=\"alignright size-full wp-image-204776\">At the end of 2020, the operator of one of the largest YouTube rippers took the unprecedented step of taking the music industry to court.<\/p>\n<p>Yout.com\u2019s Johnathan Nader was fed up with a bombardment of DMCA takedown requests and alleged defamatory claims. In response, <a href=\"https:\/\/torrentfreak.com\/riaa-sued-by-youtube-ripping-site-over-dmca-anti-circumvention-notices-201027\/\">he sued the RIAA<\/a>, asking the federal court in Connecticut to declare his service non-infringing.<\/p>\n<p>The RIAA and other music groups had been actively trying to remove so-called YouTube rippers from Google\u2019s search results. The industry group had also prevailed in legal action against some of the sites but in its battle with Yout.com, the RIAA filed a motion to dismiss.<\/p>\n<p>Last fall, the district court decided to <a href=\"https:\/\/torrentfreak.com\/riaa-thwarts-youts-attempt-to-declare-youtube-ripping-legal-221002\/\">dismiss the matter<\/a>, handing a win to the RIAA. Judge Stefan Underhill ultimately concluded that Yout had failed to show that it doesn\u2019t circumvent YouTube\u2019s technological protection measures. That rendered Yout\u2019s defamation and business disparagement claims moot.<\/p>\n<h2>Yout.com Appeal<\/h2>\n<p>Yout\u2019s operator did not give up on the case and opted <a href=\"https:\/\/torrentfreak.com\/yout-com-reignites-riaa-stream-ripping-dispute-at-court-of-appeal-230203\/\">to appeal<\/a> in the belief that YouTube rippers do not violate the DMCA. The argument received backing from the <a href=\"https:\/\/torrentfreak.com\/github-and-eff-back-youtube-ripper-in-legal-battle-with-the-riaa-230210\/\">EFF and GitHub<\/a> in their supporting amicus briefs.<\/p>\n<p>The RIAA filed a lengthy response <a href=\"https:\/\/torrentfreak.com\/riaa-counters-yout-com-stream-ripper-brief-at-u-s-court-of-appeal-230505\/\">concluding<\/a> that Yout is an \u201cillicit stream-ripping service\u201d that effectively allows people to \u201cbypass YouTube\u2019s technological restrictions\u201d that prevent downloading of works streamed through YouTube. As such, the service violates the DMCA, a position <a href=\"https:\/\/torrentfreak.com\/copyright-alliance-backs-riaa-in-key-youtube-ripper-lawsuit-230515\/\">supported<\/a> by the Copyright Alliance.<\/p>\n<p>One of the key issues in this dispute is whether YouTube actually implemented technological measures designed to control access to copyrighted works. In Yout\u2019s response to the RIAA filed this weekend, the focus returns to the same thorny topic.<\/p>\n<p>Yout\u2019s reply brief stresses that this case was dismissed prematurely, even before both parties were allowed to conduct discovery. That\u2019s problematic, as the lawsuit deals with key questions relating to the DMCA, many of which remain unanswered. <\/p>\n<h2>The Elephant-Sized Hole<\/h2>\n<p>The stream-ripper points out that rightsholders haven\u2019t implemented any copy protection measures themselves. The RIAA argues that YouTube has but according to Yout\u2019s lawyer, it still isn\u2019t clear whether YouTube\u2019s technical hurdles were intended to act as copyright protection measures.<\/p>\n<p>\u201c[RIAA] attempts to argue not only that it is entitled to rely on technology that it claims to have been put in place by YouTube, but that it makes no difference at all whether YouTube intended for the technology to limit the access to or the ability to copy the videos that are freely available on YouTube to anyone with an internet connection and a browser.\u201d <\/p>\n<p>This leaves an elephant-sized hole in the room. While the case centers around YouTube\u2019s alleged copyright protections, which are presumably vital to the music industry, YouTube itself is notably absent. It didn\u2019t file an amicus brief to back up the RIAA\u2019s position, for example.<\/p>\n<p>\u201d [\u2026] one might have assumed that YouTube itself would have appeared on Appellants behalf as an amicus. That it did not leaves an elephant sized hole in the room,\u201d Yout argues.<\/p>\n<p>Yout says the RIAA is attempting to cover this \u201cenormous hole with fig leaves.\u201d For example, the music group argues that the DMCA says nothing about the \u2018intent\u2019 of presumed protection measures, but Yout says that assertion is incorrect and defies common sense.<\/p>\n<h2>You\u2019re So Vain\u2026<\/h2>\n<p>Yout also points out that the RIAA mischaracterizes its service. The music group repeatedly stresses that the site\u2019s only purpose is to infringe the copyrights of its members, which prompted an interesting response.<\/p>\n<p>\u201cTo paraphrase one of the RIAA members\u2019 recording artists: You\u2019re so vain, I bet you think this software\u2019s about you,\u201d Yout\u2019s lawyers write, inspired by <a href=\"https:\/\/en.wikipedia.org\/wiki\/You%27re_So_Vain\">the lyrics<\/a> of Carly Simon.<\/p>\n<\/p>\n<p><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2023\/05\/apologies.jpg\" alt=\"apologies\" width=\"600\" height=\"79\" class=\"alignnone size-full wp-image-235690\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2023\/05\/apologies.jpg 770w, https:\/\/torrentfreak.com\/images\/apologies-300x39.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>In a footnote, the attorneys apologize for this reference, but their message is serious. Music only represents a small fraction of the content on YouTube, they note, adding that Yout itself is merely a dumb \u2018recording\u2019 tool.<\/p>\n<p>\u201cThe service provided by Yout is content-neutral, providing nothing more than a recording device that utilizes the very information that is freely and publicly available to anyone who cares to look for it, without the need to circumvent any technological measures. <\/p>\n<p>\u201cTo the extent that the RIAA thinks otherwise, it should have the opportunity to prove that theory\u2026 at a trial following discovery,\u201d Yout\u2019s lawyers write.<\/p>\n<h2>Dismissal Should be Reversed<\/h2>\n<p>The brief further argues that many of the legal findings cited in the RIAA\u2019s answering brief come from cases that were properly litigated; not ones that were dismissed at an early stage. <\/p>\n<p>The parties in these cases had the opportunity to build a proper record, with expert testimonies and witnesses.
