{"id":67734,"date":"2022-10-08T09:00:33","date_gmt":"2022-10-08T09:00:33","guid":{"rendered":"https:\/\/www.cryptocabaret.com\/?p=67734"},"modified":"2022-10-08T09:00:33","modified_gmt":"2022-10-08T09:00:33","slug":"bungie-ask-court-to-dismiss-aimjunkies-false-hacking-claims","status":"publish","type":"post","link":"https:\/\/www.cryptocabaret.com\/?p=67734","title":{"rendered":"Bungie Ask Court to Dismiss AimJunkies\u2019 \u2018False\u2019 Hacking Claims"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/bungie-logo.jpg\" alt=\"bungie\" width=\"300\" height=\"104\" class=\"alignright size-full wp-image-225141\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/bungie-logo.jpg 515w, https:\/\/torrentfreak.com\/images\/bungie-logo-18x6.jpg 18w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\">Over the past several years waves of copyright infringement lawsuits have targeted alleged cheaters and cheat makers.<\/p>\n<p>The legal battle between the American video game developer <a href=\"https:\/\/www.bungie.net\/\">Bungie<\/a> and <a href=\"https:\/\/www.aimjunkies.com\/\">AimJunkies.com<\/a> is one of the most litigated cases thus far. <\/p>\n<p>Last summer, Bungie <a href=\"https:\/\/torrentfreak.com\/destiny-2-creator-bungie-sues-cheat-seller-aimjunkies-for-copyright-infringement-210616\/\">filed a complaint<\/a> at a federal court in Seattle, accusing AimJunkies of copyright and trademark infringement, among other things. The same accusations were also made against Phoenix Digital Group, the alleged creators of the Destiny 2 cheating software.<\/p>\n<p>Both parties in this case are experts at high-level virtual combat. The court, however, is an entirely different playing field where the stakes are typically higher. Nonetheless, both sides have committed to winning this battle.<\/p>\n<p>Over the past year, there have been a series of allegations back and forth. Bungie is eager to shut down the cheating operation, which it believes is clearly illegal. AimJunkies disagrees and has fired back on several occasions. <\/p>\n<h2>Hacking Countersuit<\/h2>\n<p>Two weeks ago, the cheat seller denied all of Bungie\u2019s claims in court and fired back <a href=\"https:\/\/torrentfreak.com\/aimjunkies-countersues-bungie-for-hacking-and-dmca-violations-220919\/\">with a countersuit<\/a>. Among other things, it accused the game company of accessing the computer of defendant James May without authorization, which AimJunkies equates to hacking. <\/p>\n<p>AimJunkies pointed out that Bungie\u2019s license agreement (LSLA) didn\u2019t explicitly allow for this type of access at the time, and that it was updated at a later stage to permit this for anti-cheating purposes. <\/p>\n<p>Yesterday, Bungie filed a motion to dismiss these counterclaims at the federal court in Seattle, Washington. According to the game company, the hacking allegations are legally deficient and factually unsupported.<\/p>\n<h2>False and Unsupported<\/h2>\n<p>The allegations are based on a spreadsheet produced by Bungie, showing file paths on the local computer of AimJunkies\u2019 James May. However, Bungie notes that it was May who initiated these connections, not the other way around. <\/p>\n<p>\u201cMay\u2019s allegations regarding Bungie\u2019s supposed \u2018access\u2019 of his computer are simply false,\u201d Bungie\u2019s motion to dismiss reads. <\/p>\n<p>\u201cThe purported evidence May relies on, which Counterclaimants attach to their counterclaims, does not show Bungie downloading files from May\u2019s computer; it shows metadata of processes on May\u2019s computer that he connected to the Destiny 2 process, such as May\u2019s \u2018Reverse Engineering Tool[s]\u2019.\u201d<\/p>\n<\/p>\n<p><center><strong>Declaration from Bungie\u2019s engineering lead<\/strong><\/center><br \/><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/connect.jpg\" alt=\"no hacking\" width=\"600\" height=\"277\" class=\"alignnone size-full wp-image-225152\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/connect.jpg 1476w, https:\/\/torrentfreak.com\/images\/connect-18x8.jpg 18w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>Even if Bungie had initiated the connection, the claim would be legally insufficient since May does not allege any significant harm or injury, which is required to make the case for hacking, Bungie adds.<\/p>\n<p>In addition, Bungie argues that it would be allowed to access May\u2019s computer under its privacy policy, which is referenced in the LSLA. This broadly worded policy allows the company to access the computers of Destiny 2 players under certain circumstances. <\/p>\n<p>\u201cMay\u2019s counterclaims do not include any factual allegations demonstrating that the data purportedly collected by Bungie falls outside of these categories of data he agreed to allow Bungie to collect,\u201d Bungie writes. <\/p>\n<h2>Bungie Rebuts DMCA Claims<\/h2>\n<p>Aside from the hacking claims, AimJunkies also accused Bungie of violating the DMCA\u2019s anti-circumvention provisions. The game company had to do so in order to access the loader software, the cheat seller said.<\/p>\n<p>Bungie asks the court to dismiss this claim as well. There is no evidence that the company \u201ccircumvented\u201d anything and, on top of that, AimJunkies doesn\u2019t show that the loader is a protected copyrighted work, as the DMCA requires.<\/p>\n<p>\u201cPhoenix Digital alleges that Bungie accessed its \u2018proprietary loader software,\u2019 but Phoenix Digital does not allege that this loader software constitutes a copyrighted work.\u201d<\/p>\n<h2>Unsupported, False and Damaging<\/h2>\n<p>According to Bungie, it\u2019s crystal clear that the counterclaims should be dismissed. The game maker argues that they are unsupported, false, and intended to damage its reputation.<\/p>\n<p>To illustrate this, the motion mentions that AimJunkies\u2019 David Schaefer sent an email (<a href=\"https:\/\/www.youtube.com\/watch?v=2aQeBeXuj5s\">2:05<\/a>) to lawyer and YouTuber <a href=\"https:\/\/www.youtube.com\/c\/HoegLaw\">Richard Hoeg<\/a>, showing an interesting take on the legal term \u201con information and belief.\u201d<\/p>\n<p>This phrase of often used in legal paperwork to illustrate that statements are based on secondhand information that the declarant believes is true. According to Schaefer, it\u2019s code for \u201cit\u2019s not true but were going to throw this out there and see if it sticks with the judge.\u201d<\/p>\n<\/p>\n<p><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/lawyerlooks.jpg\" alt=\"lawyerlooks\" width=\"600\" height=\"185\" class=\"alignnone size-full wp-image-225150\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2022\/10\/lawyerlooks.jpg 1162w, https:\/\/torrentfreak.com\/images\/lawyerlooks-18x6.jpg 18w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>The characterization referred to Bungie\u2019s use of this term. However, it also suggests that AimJunkies would use it similarly. <\/p>\n<p>\u201cCounterclaimants have apparently taken this erroneous definition to heart and acted in accordance, alleging claims with no basis to \u2018get away with\u2019, allegations that they know are \u2018not true\u2019 to \u2018see if it sticks\u2019.<\/p>\n<p>\u201cTo state the obvious, Schaefer is mistaken; alleging facts \u2018on information and belief\u2019 does not justify or excuse making knowingly false allegations or \u2018get[ting] away\u2019 with libel (or slander),\u201d Bungie adds. <\/p>\n<p>Based on the above, Bungie asks the court to dismiss the counterclaim with prejudice.
