{"id":52881,"date":"2020-12-08T09:01:14","date_gmt":"2020-12-08T09:01:14","guid":{"rendered":"https:\/\/www.cryptocabaret.com\/?p=52881"},"modified":"2020-12-08T09:01:14","modified_gmt":"2020-12-08T09:01:14","slug":"team-xecuter-defendant-garyopa-is-a-flight-risk-and-remains-in-prison","status":"publish","type":"post","link":"https:\/\/www.cryptocabaret.com\/?p=52881","title":{"rendered":"Team-Xecuter Defendant \u2018GaryOPA\u2019 is a Flight Risk and Remains in Prison"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/12\/xecuter-logo.jpg\" alt=\"team xecuter\" width=\"330\" height=\"98\" class=\"alignright size-full wp-image-194721\">Hacking group Team-Xecuter has long been a thorn in the side of major gaming companies.<\/p>\n<p>The group offers hardware and software solutions that allow people to install and play unofficial games \u2013 including pirated copies \u2013 on various consoles, including the popular Nintendo Switch.<\/p>\n<p><a href=\"https:\/\/torrentfreak.com\/team-xecuter-accuses-nintendo-of-censorship-and-legal-scare-tactics-200611\/\">Team-Xecuter often defended its work<\/a> by pointing out that their products are not necessarily pirate tools. They are supporters of the \u2018right to repair\u2019 movement and back people who want to play homebrew games on their devices for personal use. <\/p>\n<p>The affected game companies disagree, with Nintendo front and center. The Japanese gaming company has been chasing down Team-Xecuter for years and a few months ago the company took several online stores to court <a href=\"https:\/\/torrentfreak.com\/nintendo-sues-stores-selling-new-team-xecuter-switch-piracy-hack-200518\/\">for selling Team-Xecuter products<\/a>. <\/p>\n<p>In October, these enforcement efforts reached a new level when the US Government <a href=\"https:\/\/torrentfreak.com\/us-indicts-several-members-of-piracy-group-team-xecuter-two-arrested-201002\/\">launched a criminal prosecution<\/a> of three of the group\u2019s members. <\/p>\n<h2>Bowser aka \u2018GaryOPA\u2019<\/h2>\n<p>One of the defendants is Canadian Gary Bowser. He was arrested in the Dominican Republic in September and was deported to the US soon after. Bowser was allegedly responsible for the development of circumvention devices and maintained regular contact with resellers.<\/p>\n<p>Bowser is perhaps best known through his nickname GaryOPA, the supposed operator and a frequent writer on the website \u201cMaxConsole,\u201d which regularly reviewed Team-Xecuter hardware and other hacking tools.<\/p>\n<h2>Flight Risk<\/h2>\n<p>In a \u2018Zoom\u2019 hearing held last week, a federal court in Seattle reviewed a request for pretrial detention, submitted by the US prosecution. It is not uncommon for criminal defendants to be released on bail pending their trial, but the US argues against this in Bowser\u2019s case, as he\u2019s considered a \u2018flight risk.\u2019 The court agrees.<\/p>\n<p>\u201cDefendant poses a risk of nonappearance due to his lack of ties to this district, ties to Canada and the Dominican Republic, ownership of a Canadian passport, history of international travel, unstable living situation, and an uncorroborated personal history,\u201d US Magistrate Judge Michelle Peterson writes.<\/p>\n<p>\u201cBased on these findings, and for the reasons stated on the record, there does not appear to be any condition or combination of conditions that will reasonably assure the Defendant\u2019s appearance at future court hearings,\u201d she adds.<\/p>\n<\/p>\n<p><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/12\/flightrisk3.jpg\" alt=\"flight risk\" width=\"600\" height=\"360\" class=\"alignnone size-full wp-image-197679\" srcset=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/12\/flightrisk3.jpg 1732w, https:\/\/torrentfreak.com\/images\/flightrisk3-1536x921.jpg 1536w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\"><\/center><\/p>\n<p>Bowser was not interviewed by the court, which currently has no information on his family ties, personal history, or employment. That leaves the door open to reopening the detention hearing at a future date, which may change things. <\/p>\n<h2>The Other Defendants<\/h2>\n<p>There is no update on the other defendants at this point. Based on the information in the court dockets, Yuanning Chen from China is still at large. According to the indictment, Chen managed a manufacturing and distribution company where Team-Xecuter\u2019s hardware was made.<\/p>\n<p>The third defendant, French national Max Louarn, was arrested in Canada where a U.S. extradition request was launched. The US Government sees Louarn, who\u2019s hacking track record goes back to the early nineties, as the leader of Team-Xecuter. <\/p>\n<p>Louarn allegedly made Team-Xecuter\u2019s important business decisions, arranged investors and financing, and oversaw product development and the wholesale distribution chains.<\/p>\n<h2>Nintendo Takes Over Domains<\/h2>\n<p>The US criminal prosecution is not the only legal pressure on Team-Xecuter. Nintendo has also seen very active on the legal front. One of the stores it sued earlier this year, Axiogame.com, was <a href=\"https:\/\/torrentfreak.com\/nintendo-sued-team-xecuter-without-knowing-it-201007\/\">allegedly operated by Team-Xecuter<\/a>. That has been shut down through Nintendo\u2019s lawsuit. <\/p>\n<p>The Axiogame.com domain is now owned by Nintendo and over recent days the gaming company took over several other domains of former piracy hack stores, assisted by an <a href=\"https:\/\/torrentfreak.com\/court-orders-godaddy-to-transfer-piracy-hack-store-domain-to-nintendo-201128\/\">updated court order<\/a>.<\/p>\n<p>Flashcarda.com switched to the new Materpl.com domain and both are owned by Nintendo now. The same is true for Txswitch.com that switched to Stxwitch.com, Usachipss.com that moved to Nerged.com, and several other domains.<\/p>\n<\/p>\n<p><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/12\/nerged.jpg\" alt=\"nerged.com\" width=\"600\" height=\"325\" class=\"alignnone size-full wp-image-197680\"><\/center><\/p>\n<h2>Team-Xecuter Continues<\/h2>\n<p>Despite the mounting legal pressure, Team-Xecuter is far from defeated. In fact, the site\u2019s main website <a href=\"https:\/\/team-xecuter.com\/\">remains online<\/a>. The forum remains active as well, with people privately offering help to install or buy mods. <\/p>\n<p>Team-Xecuter\u2019s dedicated page for the <a href=\"https:\/\/sx.xecuter.com\/\">SX product line<\/a> is also still intact. This links to a list of authorized resellers.
