{"id":51723,"date":"2020-10-25T09:01:00","date_gmt":"2020-10-25T09:01:00","guid":{"rendered":"https:\/\/www.cryptocabaret.com\/?p=51723"},"modified":"2020-10-25T09:01:00","modified_gmt":"2020-10-25T09:01:00","slug":"riaa-takes-down-popular-open-source-youtube-dl-software","status":"publish","type":"post","link":"https:\/\/www.cryptocabaret.com\/?p=51723","title":{"rendered":"RIAA Takes Down Popular Open Source YouTube-DL Software"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/10\/youtube-error-1.jpg\" alt=\"youtube sad error\" width=\"300\" height=\"209\" class=\"alignright size-full wp-image-195351\">Every day, copyright holders send out millions of takedown notices to various services, hoping to protect their works.<\/p>\n<p>Most notices target content that\u2019s clearly copyright-infringing, but others are open to interpretation or debate.<\/p>\n<p>This is also the case with a <a href=\"https:\/\/github.com\/github\/dmca\/blob\/f3feb29111333c6fb5614f126b11eb5a71b08e82\/2020\/10\/2020-10-23-RIAA.md\">takedown notice<\/a> that was sent by the RIAA this week. The music industry\u2019s anti-piracy group asked GitHub to remove the open-source YouTube-DL repository as well as several forks. <\/p>\n<h2>Stream-Ripping Piracy<\/h2>\n<p>YouTube-DL is widely used by individuals and some stream-ripper sites to download videos from YouTube.com and other platforms. These can range from public domain videos to copyrighted music tracks. <\/p>\n<p>GitHub responded swiftly to the notice and removed all of the YouTube-DL repositories, which <a href=\"https:\/\/github.com\/ytdl-org\/youtube-dl\">now show<\/a> a DMCA takedown notification instead.<\/p>\n<\/p>\n<p><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/10\/youtube-dl.jpg\" alt=\"github dmca\" width=\"600\" height=\"255\" class=\"alignnone size-full wp-image-195800\"><\/center><\/p>\n<p>While these stream-ripping tools can be used to download non-infringing content, as digital rights group <a href=\"https:\/\/torrentfreak.com\/eff-backs-stream-rippers-in-legal-battle-against-record-labels-190419\/\">EFF highlighted in the past<\/a>,  millions of people use them to download personal copies of music tracks. <\/p>\n<p>In fact, the music industry sees stream-ripping as the <a href=\"https:\/\/torrentfreak.com\/prs-music-reports-mysterious-stream-ripping-boom-in-dubious-piracy-report-200926\/\">single biggest piracy threat<\/a>. This is also how the group motivates its takedown request to GitHub.  <\/p>\n<p>\u201cThe clear purpose of this source code is to (i) circumvent the technological protection measures used by authorized streaming services such as YouTube, and (ii) reproduce and distribute music videos and sound recordings owned by our member companies without authorization for such use.\u201d<\/p>\n<h2>Anti-Circumvention Violations<\/h2>\n<p>As we have seen in the past, <a href=\"https:\/\/torrentfreak.com\/riaa-delists-youtube-rippers-from-google-using-rare-anti-circumvention-notices-191108\/\">RIAA cites the anti-circumvention provisions<\/a> of the DMCA, which prohibits the public from bypassing technological protection measures. While it\u2019s YouTube\u2019s protection measures being bypassed in this case, the RIAA member labels are among the \u2018victims.\u2019<\/p>\n<p>According to the RIAA, the source code includes several samples that show how people can download tracks from Icona Pop, Justin Timberlake, and Taylor Swift, without permission.<\/p>\n<h2>Source Code Mentions Copyrighted Content<\/h2>\n<p>\u201cThe source code notes that the Icona Pop work identified above is under the YouTube Standard license, which expressly restricts access to copyrighted works only for streaming on YouTube and prohibits their further reproduction or distribution without consent of the copyright owner,\u201d RIAA writes. <\/p>\n<\/p>\n<p><center><strong>From RIAA\u2019s takedown notice<\/strong><\/center><center><br \/><\/center><center><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.cryptocabaret.com\/wp-content\/uploads\/2020\/10\/youtube-dlgit.jpg\" alt=\"riaa takedown\" width=\"600\" height=\"156\" class=\"alignnone size-full wp-image-195801\"><\/center><\/p>\n<p>According to the RIAA, YouTube-DL\u2019s code is primarily designed and marketed for circumventing YouTube\u2019s technological measures, which violates <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/17\/1201\">17 USC \u00a7\u00a71201(a)(2) and 1201(b)(1<\/a>) of the DMCA.<\/p>\n<p>While there is little jurisprudence in US Courts about stream-rippers specifically, the music group points to a decision from the Hamburg Regional Court in a similar case, which found that YouTube\u2019s \u201crolling cipher\u201d is an effective technological protection measure under EU law.<\/p>\n<h2>YouTube-DL Remains Online<\/h2>\n<p>TorrentFreak reached out to the YouTube-DL developers to hear their side of the story but they prefer not to comment for now. <\/p>\n<p>However, it appears that they don\u2019t plan to throw in the towel just yet. The yt-dl.org website remains online and it still lists a recently modified version of the code. <\/p>\n<p>In addition, the website was updated to remove links to GitHub pages that were taken down. This includes the <a href=\"https:\/\/yt-dl.org\/about.html\">about page<\/a>, which now long longer lists the name of the developers.<\/p>\n<p>The YouTube-DL takedown is part of a broader campaign against stream-ripping tools.
